Kentucky School Law Attorneys

Adams Law boasts one of the largest, dedicated school law practice groups in the Greater Cincinnati and Northern Kentucky area, providing general counsel and litigation support services to both large county-wide school districts as well as the smaller, independent school districts throughout the Commonwealth of Kentucky.   The attorneys in the school law practice group have between them over forty years of combined experience guiding and shaping the public school landscape.

There is no higher calling in public service than public education.  Now more than ever, children need a solid educational foundation to foster and hone their knowledge, skills, and creativity in order to become successful leaders in an increasingly competitive, global society.  At Adams Law, we provide day-to-day support and guidance to the boards of education which set overall policy as well as to the administrators tasked with implementing those policies.  In the course of that representation, we navigate through complex state and federal regulatory challenges, student discipline, and litigation, with the goal of resolving each issue promptly and efficiently so that our school district clients can focus on the essential matter at hand: the education of their students.

As general counsel to multiple school districts, we have provided advice, guidance, and support in areas such as: student discipline, suspension and expulsions, and positive behavior intervention services and support; certified and classified employment issues, hearings, and tribunals; athletic regulations and gender equity in sports; transportation issues; homelessness regulations and compliance; drafting of board policies; contract negotiation and drafting; superintendent search requirements and processes; bond issuance and construction of new facilities; and school health protocols.

For over forty years we have been a reliable authority in school law recognized by both our clients and the Courts before whom we practice.  Our successes in the courtroom have been varied and numerous, and have run the gamut of litigation claims, such as those arising from employment disputes, attendance zone disputes, construction issues, negligent supervision or negligent implementation of policy.  Our team was responsible for creating binding precedent in the Sixth Circuit Court in a landmark case under special education law, which has been cited by other federal courts of appeals, and which was nationally recognized by the National School Boards Association.

Special Education Law

In addition to general services provided to our school district clients, we also provide consulting and litigation support in the area of special education law.  We represent school districts and administrators who provide services and support for students who qualify for specialized education under the Individuals with Disabilities Education Act (IDEA).  This includes compliance with school identification and evaluation of children with special needs; development of individualized education plans (IEPs) and 504 plans; development of behavioral plans and conduct of manifestation hearings; placement issues, including least restrictive environment and mainstreaming; evaluation of compensatory education offerings and the need for such; and litigation of Due Process hearings, Exceptional Children Appeals Board (ECAB) and subsequent Federal Court proceedings.   Several of our attorneys have been featured speakers and presenters on special education law and discipline at seminars sponsored by the Kentucky School Board Association, National Business Institute, and the Kentucky Bar Association, and they have authored numerous articles on these topics for state, local, and national organizations, including the National School Boards Association and DRI (Defense Research Institute).

Community Partner

Aside from our professional work with schools, we believe in giving back to our local schools and communities. Adams Law lawyers have volunteered their time as mentors to inner-city schools; have volunteered their time teaching and participating in school-led career days; and the firm has proudly sponsored scholarship opportunities for students lacking the financial means to attend college.  Several of our attorneys sit as members on local educational foundations and non-profits dedicated to providing financial support and funding for public schools and public school programs.   We are advocates for public education both in our professional and private lives.  We support and are members of the National School Boards Association, DRI, the Kentucky School Board Association, Kentucky Defense Counsel, Inc., and the Council of School Attorneys. In fact, many of our Attorneys have held leadership positions within these organizations and others that advocate for public education, including the Northern Kentucky Education Council, Kentucky Educational Television, and various educational foundations.
