Attorneys Jeff Mando and Dan Linneman recently won summary judgment for the City of Newport in claim for personal injuries arising from a trip and fall. The Plaintiff claimed the City was negligent because its schedule for clearing leaves in an unpaved area between the sidewalk and the street was inadequate. The Plaintiff walked into the area while carrying several large boxes and tripped on a rock, injuring herself. The Campbell Circuit Court granted summary judgment to Newport finding that claims arising from a City’s decisions about how best to allocate limited resources are barred by Kentucky’s Claims Against Local Governments Act, KRS 65.2001 et seq.
