ASWD School Law Attorney Offers Practical Guidance for Settling Special Education Disputes
The Adams, Stepner, Woltermann & Dusing School Law Practice Group was represented well at the Kentucky Council of School Board Attorneys Summer Meeting on Friday, July 12th. In a presentation entitled “Settling Special Education Disputes: Practical Tips to Avoid the Pitfalls”, Claire E. Parsons shared some of her experiences settling due process litigation arising under the Individuals with Disabilities Education Act, 20 U.S.C. 1400, et seq. In particular, she offered pointers for issuing offers of settlement pursuant to 20 U.S.C. 1415 to mitigate the risk of attorney fee exposure and a number of tips for drafting settlement agreements specific to special education litigation.
