Adams Stepner Government Practice Group Secures Summary Judgment on Excessive Force Claims

Jeff Mando and Claire Parsons, both Members of the Firm’s Local Government and Litigation practice groups, recently secured summary judgment in Senters v. Boyd County. The Plaintiff, Julia Senters, claimed that deputies from Boyd County Sheriff’s Department used excessive force during her arrest that occurred while the deputies investigated an assault at her home. Though Senters asserted that the deputies violated her Fourth Amendment and Due Process rights, the District Court rejected her arguments and found that they were entitled to qualified immunity. The District Court also found that Boyd County could not be held responsible for the alleged violation of Senters’ rights because 42 U.S.C. § 1983 did not allow her to sue a local government based on the theory of vicarious liability. Since Senters had failed to show that the County had adopted officially or unofficially a policy of deliberate indifference to civil rights violations, it dismissed her claims.
