Adams Stepner Attorneys Win Defamation Case in Court of Appeals
Adams Stepner attorneys Jeffrey Mando and Dan Linneman won a comprehensive victory for the Carroll County Sheriff in the Kentucky Court of Appeals in Otis Collins v. Carroll County Sheriff. The Plaintiff had sued the Sheriff for defamation, libel, false light, invasion of privacy, slander, violation of Kentucky’s expungement statute, intentional infliction of emotional distress, and negligent infliction of emotional distress after the Sheriff posted an article about Plaintiff’s arrest for child abuse on its website. Mando and Linneman won summary judgment on all claims in the Carroll Circuit Court and the Plaintiff appealed to the Kentucky Court of Appeals. On February 1, 2019, the Court of Appeals rendered an opinion affirming the Circuit Court’s judgment in all respects. The Court held that the Sheriff was immune from Plaintiff’s tort claims and that the Plaintiff had failed to support his claims for negligent and intentional infliction of emotional distress with sufficient evidence to warrant a trial.
