Adams Stepner Attorneys Secure Judgment on School Negligence Claims

The Adams Stepner Government Practice and Litigation Group secured yet another victory.  On March 30th, the Kenton Circuit Court dismissed the personal injury claims asserted in Keen v. Covington Independent Public Schools, et al., Case No. 16-CI-00150.  The plaintiff’s claims, brought against the school district and three of its employees, were premised upon an incident during which a third party individual injured the plaintiff after school.  Earlier in the litigation, Ms. Stewart filed a successful Motion for Judgment on the Pleadings which resulted in the dismissal of all claims against the school district and its superintendent on the basis of governmental and qualified official immunity. While discovery proceeded against two district employees, a teacher and principal, in their individual capacities, Ms. Parsons filed a Motion for Summary Judgment, asserting that both defendants were entitled to qualified official immunity on all claims.  The motion further asserted that plaintiff’s negligence claims failed as a matter of law, because the plaintiff was unable to demonstrate any breach of duty based on the defendants’ actions.  The Kenton Circuit Court agreed, granting summary judgment and dismissing the plaintiff’s claims.
