Adams Stepner Member, Claire E. Parsons, presented at the Kentucky School Board Association Council of School Board Attorneys Winter Meeting on Friday, March 2, 2018. Claire is a member of the Firm’s Local Government and School Law practice groups and regularly presents on issues relating to school law and special education. Her presentation entitled, “Napoleon Complexities: US Supreme Court IDEA Precedents on Administrative Exhaustion and Fape” provided an overview to Council members regarding two new United States Supreme Court precedents in the area of special education law issued last term. In particular, Claire provided a detailed analysis of Endrew F. v. Douglass County School District Re-1, which set a new standard in adjudicating denial of FAPE claims under the IDEA. Additionally, Claire discussed Fry v. Napoleon Community Schools, an opinion which elucidated the line between claims subject to IDEA’s administrative exhaustion requirement and claims which may be filed directly in court without exhaustion. Claire then explained to Council members how both cases are likely to impact special education due process claims and other claims involving disabled students in the future.
